La terminación anticipada en la solución del conflicto jurídico penal, en el distrito judicial de Ica, 2017

Abstract

La terminación anticipada es un mecanismo de negociación y solución del conflicto penal que permite la culminación del proceso penal previo acuerdo entre el imputado y el agraviado, el objetivo .determinar la influencia de la terminación anticipada en la solución del conflicto jurídico penal, en el distrito judicial de Ica, 2017, la Metodología fue de ttipo Jurídico-social, el nivel no experimental, y el diseño cuantitativos y cualitativos, la muestra fue de 364 unidades muéstrales. Resultados: en un proceso de terminación anticipada, son aplicables las reglas del juicio oral en segunda instancia, pese a que no hubo juicio oral en primera instancia, o debe tramitarse como una apelación de autos, el 41.5% de los encuestados respondieron que sí, el 26.2% que no y el 32.3% no saben; la reducción de la pena, debe tomarse el mínimo establecido en el tipo penal, o la pena acordada entre el Fiscal y el imputado, el 45.3% de los encuestados respondieron que sí, el 32.8% que no y el 21.9% no saben; los resultados de puede ser Desaprobado el Acuerdo, el 38.5% de los encuestados respondieron que sí, el 32.3% que no y el 29.2% no saben. Conclusión: De la información obtenida concluimos que la terminación anticipada en la solución del conflicto jurídico penal, en el distrito judicial de Ica, influye la disminución de la carga procesal.

Results: in a process of early termination, the rules of the oral trial are applicable in the second instance, although there was no oral trial in the first instance, or should be processed as an appeal of the case, 41.5% of the respondents answered yes, 26.2% do not and 32.3% do not know; the reduction of the penalty, should be taken the minimum established in the criminal type, or the penalty agreed between the Prosecutor and the accused, 45.3% of respondents answered yes, 32.8% not and 21.9% do not know; The results of the Agreement can be Deprecated, 38.5% of the respondents answered yes, 32.3% do not and 29.2% do not know. Conclusion: From the information obtained we conclude that the early termination in the resolution of the criminal legal conflict, in the judicial district of Ica, influences the decrease of the procedural burden.
