Nulidad del proceso penal por violación de la garantía de la defensa en el distrito judicial de Ica, año 2019-2020

Abstract

El objetivo de la presente investigación fue determinar el nivel de relación entre la nulidad del proceso penal y la violación de la garantía de la defensa en el distrito judicial de Ica, año 2019 - 2020. En el estudio se utilizó el enfoque cuantitativo; el método fue jurídico y dogmático, siendo el estudio de tipo básico, con diseño no experimental, haciendo uso de la técnica de la observación y encuesta, con una encuesta aplicada a la muestra seleccionada de jueces (10) y abogados (52). Si bien es cierto la defensa como derecho es parte esencial en cualquier acto procesal, donde su reconocimiento no solamente debe ser formal, sino de estricto cumplimiento. Cuando se quebranta este derecho, el proceso penal se vuelve nulo, comprobándose que el abogado, sea de confianza u oficio, actuó negligentemente por presentar una defensa inadecuada a la que exigía el enfrentamiento de la imputación. Confirmando este criterio es evidente la nulidad de la instrucción, ya no por defensa deficiente, sino por ausencia de esta.

The objective of the present investigation was to determine the level of relationship between the nullity of the criminal process and the violation of the guarantee of the defense in the judicial district of Ica, year 2019 -2020. The quantitative approach was used in the study; the method was legal and dogmatic, being the study of a basic type, with a non-experimental design, using the technique of observation and survey, with a survey applied to the selected sample of judges (10) and lawyers (52). Although it is true that defense as a right is an essential part of any procedural act, where its recognition must not only be formal, but must be strictly complied with. When this right is violated, the criminal process becomes null, proving that the lawyer, whether trusted or ex officio, acted negligently by presenting an inadequate defense to which the confrontation of the accusation demanded. Confirming this criterion, the nullity of the instruction is evident, not because of a deficient defense, but because of its absence.
