Resumen
Se realizó un minucioso análisis sobre el procedimiento administrativo vinculado al cierre
de partidas por duplicidad y la seguridad jurídica en el Registro de Predios de la Oficina Registral
de Ica. Este estudio intentó descubrir la relación entre ambos componentes y de qué manera esta
relación
afecta la publicidad registral y la confiabilidad de las inscripciones.
Con una metodología cuantitativa de diseño correlacional, se repartieron encuestas a los
trabajadores de la Oficina Registral de Ica. Estos recursos analizan varios factores, como el grado
de formación del personal, la efectividad de los procedimientos implementados y como esta
influye en la percepción de la seguridad jurídica y la claridad en el registro.
Los hallazgos mostraron una evaluación significativamente alta y positiva entre el cierre
de partidas por duplicidad y la seguridad jurídica, con un coeficiente de Spearman de 0.925 (p <
0.01). Además, se considera que la duplicidad de partidas con inscripciones incompatibles
produce un impacto negativo considerable en la seguridad jurídica (Rho = 0.964, p < 0.01), lo que
subraya su impacto en la claridad y la confianza en los derechos de propiedad. En lo referido a la
publicidad registral, el procedimiento también evidenció una sólida compensación positiva (Rho
= 0.913, p < 0.01), lo que indica que su correcta aplicación potencia tanto la certeza como la
confiabilidad en la información registrada.
Los estudios determinan que el procedimiento administrativo mediante el cual se cierra
partidas por duplicidad es crucial para robustecer la seguridad jurídica y la publicidad de
información registral. No obstante, se identificaron deficiencias en la formación del personal y en
la normalización de los procesos, lo que restringe la eficacia de este procedimiento. Para
establecer un sistema de registro confiable y eficaz, se aconseja incrementar la capacitación del
personal, incorporar tecnologías de vanguardia para el análisis catastral y de esta manera, asegurar
la certeza de la información que se publicita.
This study examined the connection between the administrative process of closing duplicate entries and legal certainty within the property registry of the Ica Registry Office in 2023. It also sought to understand how this relationship influences registry publicity and the reliability of registrations. A quantitative approach with a correlational design was employed, involving surveys of registry office staff to assess factors such as training, procedural effectiveness, and their impact on perceptions of legal certainty and transparency. The findings revealed a very strong positive correlation between the duplicate entries closure procedure and legal certainty (Spearman’s Rho = 0.925, p < 0.01). Furthermore, it was observed that duplicate entries with conflicting inscriptions significantly undermine legal certainty (Rho = 0.964, p < 0.01), emphasizing their detrimental effect on clarity and confidence in property rights. As for registry publicity, the procedure showed a strong positive correlation (Rho = 0.913, p < 0.01), suggesting that its proper implementation improves the transparency and accessibility of registered information. The study concluded that the process of closing duplicate entries is vital for reinforcing legal certainty and registry publicity. However, gaps in staff training and process standardization were identified, limiting its effectiveness. It is recommended to improve staff training, adopt advanced cadastral analysis technologies, and enhance transparency in the dissemination of information to ensure the establishment of a reliable and efficient registry system.
