El estado especial de vulnerabilidad del propietario legítimo y su incidencia en la buena fe del tercero

Abstract

El presente trabajo de investigación lleva por título “El estado especial de vulnerabilidad del propietario legítimo y su incidencia en la buena fe del tercero”; estableciendo como objetivo general, determinar de qué manera el estado especial de vulnerabilidad del propietario legítimo incide en la buena fe del tercero; como objetivos específicos, analizar como la fragilidad socio-económica del propietario legítimo impide la protección del tercero de buena fe y explicar cómo los criterios jurisprudenciales respecto al tercero de buena fe inciden en la incertidumbre jurídica en el mercado inmobiliario. Con respecto a la metodología, se empleó el enfoque cualitativo con un diseño interpretativo basado en la teoría fundamentada; como instrumentos de recolección de datos se empleó la guía de entrevista, como técnica la entrevista, la cual constó de 7 preguntas abiertas, formuladas en base a los objetivos planteados; arribando a la conclusión que, el estado especial de vulnerabilidad del propietario legítimo incide significativamente en la buena fe del tercero, esta vulnerabilidad establecida mediante jurisprudencia del Tribunal Constitucional, introduce un elemento adicional que complica la configuración y protección del adquirente de buena fe; en ese sentido, los criterios jurisprudenciales que enfatizan la protección del propietario en situación de vulnerabilidad, aunque bien intencionados, generan una dualidad de intereses, que deja en desprotección los derechos adquiridos por el tercero, quien fundamenta su adquisición en la buena fe registral.

The present research work is entitled “The special state of vulnerability of the legitimate owner and its impact on the good faith of the third party”; establishing as general objective, to determine how the special state of vulnerability of the legitimate owner affects the good faith of the third party; as specific objectives, to analyze how the socio-economic fragility of the legitimate owner prevents the protection of the third party in good faith and to explain how the jurisprudential criteria regarding the third party in good faith affect the legal uncertainty in the real estate market. With respect to the methodology, the qualitative approach was used with an interpretative design based on the grounded theory; the interview guide was used as data collection instruments and the interview technique consisted of 7 open questions, formulated on the basis of the stated objectives; The conclusion reached was that the special state of vulnerability of the legitimate owner has a significant impact on the good faith of the third party, this vulnerability established by the jurisprudence of the Constitutional Court, introduces an additional element that complicates the configuration and protection of the purchaser in good faith; in this sense, the jurisprudential criteria that emphasize the protection of the owner in a situation of vulnerability, although well intentioned, generate a duality of interests, which leaves the rights acquired by the third party, who bases his acquisition on the good faith of the registry, unprotected.
