Resumen
La investigación tiene como título “La primacía del principio del interés superior del niño para el
otorgamiento de la tenencia de los nietos a los abuelos”, cuenta con un enfoque cualitativo, el
diseño es interpretativo basado en la teoría fundamentada; estableció como objetivo general
determinar de qué manera la aplicación del principio del interés superior del niño viabiliza el
otorgamiento de la tenencia de menor a los abuelos; como objetivos específicos, se estableció,
determinar de qué manera la flexibilización de los principios procesales en el proceso de tenencia
de menor incide en la legitimidad e interés para obrar a favor de los abuelos; y determinar de qué
manera la observancia de la Convención sobre los Derechos del Niño incide en la admisibilidad
de la demanda de tenencia a favor de los abuelos. Como método de recolección de datos, se utilizó
la guía de entrevista estructurada, como técnica se aplicó la entrevista, conformada por 6
preguntas abiertas en base a los objetivos planteados; con la cual se concluyó que, en el ámbito
jurisdiccional, el principio del interés superior del niño, constituye no solo un derecho que debe
observar el operador de justicia al momento de analizar lo más beneficioso para el mejor; sino
que, como principio procesal dentro del proceso de familia, permite flexibilidad las instituciones
juridicas y realizar una interpretación extensiva del contenido legal, tal y como sucede con el
atributo de la tenencia cuando es ejercicio por los abuelos del menor.
The research is entitled "The primacy of the principle of the best interest of the child for the granting of the grandchildren's custody to the grandparents", has a qualitative approach, the design is interpretative based on the grounded theory; it established as general objective to determine how the application of the principle of the best interest of the child makes viable the granting of the grandchild's custody to the grandparents; The specific objectives were to determine how the flexibility of the procedural principles in the process of child custody affects the legitimacy and interest to act in favor of the grandparents; and to determine how the observance of the Convention on the Rights of the Child affects the admissibility of the demand for custody in favor of the grandparents. As a method of data collection, the structured interview guide was used, as a technique the interview was applied, consisting of 6 open questions based on the stated objectives; with which it was concluded that, in the jurisdictional field, the principle of the best interest of the child, constitutes not only a right that must be observed by the operator of justice when analyzing what is most beneficial for the best; but, as a procedural principle within the family process, it allows flexibility of the legal institutions and an extensive interpretation of the legal content, as is the case with the attribute of custody when it is exercised by the grandparents of the minor.
