Resumen
El trabajo de investigación lleva como título “Responsabilidad penal de personas jurídicas e
investigación de delitos ambientales en el distrito fiscal de Cañete, 2022”; se trabajó en base a un
enfoque cualitativo, el diseño es descriptivo basado en la teoría fenomenológica; en el se estableció
como objetivo analizar si existen limitaciones para determinar la responsabilidad penal de las
personas jurídicas en los delitos ambientales, en el Distrito Fiscal de Cañete, en el año 2022; como
objetivos específicos, se estableció conocer si es posible determinar la cadena de atribución en la
comisión de hechos punibles configurados como delitos ambientales; y analizar si es viable realizar
una correcta fundamentación legal para la imposición de una consecuencia accesoria en contra de
la persona jurídica. Como instrumento de recolección de datos se utilizó la guía de entrevista, como
técnica la entrevista, conformada por siete preguntas abiertas, elaboradas en base a los objetivos
planteados; instrumento con el cual se arribó a la conclusión que, dentro de la regulación de la
responsabilidad administrativa de las personas jurídicas, se evidencia una ausencia normativa
respecto a los delitos ambientales, en la práctica procesal, limita la capacidad de los operadores de
justicia para poder atribuir responsabilidad penal a las personas jurídicas por la comisión de delitos
ambientales; y consecuentemente, imposibilita la determinación de sanciones punitivas en estos
tipos penales, ocasionando que varios casos penales relacionados con estos delitos queden impunes.
The research work is entitled “Criminal liability of legal entities and investigation of environmental crimes in the tax district of Cañete, 2022”; it was based on a qualitative approach, the design is descriptive based on the phenomenological theory; the objective was to analyze if there are limitations to determine the criminal liability of legal entities in environmental crimes in the Fiscal District of Cañete, in the year 2022; As specific objectives, it was established to know if it is possible to determine the chain of attribution in the commission of punishable acts configured as environmental crimes; and to analyze if it is feasible to make a correct legal basis for the imposition of an accessory consequence against the legal person. The interview guide was used as an instrument of data collection, as a technique the interview, made up of 7 open questions, elaborated on the basis of the objectives set out; This instrument was used to reach the conclusion that, within the regulation of administrative responsibility of legal persons, there is an absence of regulations regarding environmental crimes, in procedural practice, which limits the capacity of justice operators to be able to attribute criminal responsibility to legal persons for the commission of environmental crimes; and consequently, it makes it impossible to determine punitive sanctions in these criminal types, causing several criminal cases related to these crimes to go unpunished.
