El delito de usurpación y las acciones del Estado frente a las invasiones en el distrito de Ocucaje, en el año 2023

Abstract

El trabajo de investigación denominado delitos de usurpación, que afecta la propiedad privado o estatal, ya sea a la persona individual o al entorno familiar, como consecuencia de las invasiones y ocupaciones clandestinas, sin importar que dichos terrenos o extensiones de parcelas son de propiedad privada, esta actitud delincuencial de apropiarse de tierras de sembríos, causa un desorden social en el distrito de Ocucaje perteneciente a la provincia de Ica, ante estas invasiones de tierras, es el Estado que tiene el derecho de accionar y poner a buen recaudo a los usurpadores, una de las acciones del Estado, es mediante las instituciones políticas, policiales y judiciales. Este fenómeno social de la usurpación e invasiones de terrenos es de larga data, pero estas acciones ilegales ya no se debe repetir, pues estamos en una época de modernidad, competitividad y de basta tecnología, que nos da a entender que todavía predomina la fuerza bruta, la matonería, la amenaza, y la falta de respeto a la autoridad y regidores del distrito de Ocucaje. Se debe tener en cuenta que la Constitución Política, protege al derecho a la propiedad y las que la usurpan e invadan se les aplicará las leyes penales y civiles, es decir, sentencias penales drásticas y firmes, y en materia civil se ordene el pago de reparaciones civil por el daño causado. El derecho a la propiedad es inalienable, se debe respeto al propietario, al entorno familiar que la habita o está en posesión de buena fe.

The research work called usurpation crimes, which affects private or state property, whether it is the individual person or the family environment, as a result of clandestine invasions and occupations, regardless of whether said lands or extensions of plots are private property, this criminal attitude of appropriating farmland, causes social disorder in the district of Ocucaje belonging to the province of Ica, in the face of these land invasions, it is the State that has the right to act and put the usurpers in safekeeping, one of the actions of the State is through political, police and judicial institutions. This social phenomenon of usurpation and invasions of land is long- standing, but these illegal actions should not be repeated, because we are in an era of modernity, competitiveness and vast technology, which gives us to understand that brute force, bullying, threats, and lack of respect for the authority and councilors of the district of Ocucaje still predominate. It should be noted that the Political Constitution protects the right to property and that those who usurp and invade it will be subject to criminal and civil laws, that is, drastic and firm criminal sentences, and in civil matters, the payment of civil reparations for the damage caused will be ordered. The right to property is inalienable, respect must be given to the owner, to the family environment that inhabits it or is in possession in good faith.
