El delito de lesiones psicológicas por violencia familiar y su perspectiva jurídico-social en los juzgados penales de la Corte Superior de Justicia de Ica - año 2022

Abstract

La investigación científico-jurídica materia de estudio tiene finalidad determinar la relación existente entre el delito de lesiones psicológicas por violencia familiar y su perspectiva jurídico-social en los Juzgados Penales de la Corte Superior de Justicia de Ica – año 2022; sobre lo cual hemos analizado y resumido tesis y trabajos de investigación nacionales e internacionales, en el que se aprecia la preocupación de diferentes investigadores con respecto al delito de lesiones psicológicas por violencia familiar . La investigación matera de estudio es de tipo básica, diseño descriptivo-correlacional, usando como instrumento de recolección de datos a la encuesta o cuestionarios, que fue realizado a 60 personas, entre ellos funcionarios públicos, magistrados, abogados, litigantes y personas elegidas de manera aleatoria, relacionados con el delito de lesiones psicológicas por violencia familiar y su perspectiva jurídico-social en los Juzgados Penales de la Corte Superior de Justicia de Ica – año 2022. Por lo tanto, habiendo realizado un análisis estadístico de las encuestas antes referidas, se ha determinado que la hipótesis general tiene una correlación positiva perfecta, donde r = 1; en cuanto a la hipótesis específica 1 tiene una correlación positiva considerable, donde r = 0,874; la hipótesis específica 2 tiene una correlación positiva considerable, donde r = 0,820; y, la hipótesis específica 3 tiene una correlación positiva considerable, donde r = 0,785. Teniendo adicionalmente un aporte jurídico-legislativo, remitiendo un proyecto de ley al Colegio de Abogados de Ica, de donde soy miembro activo, sugiriendo el investigador en cuanto al delito de lesiones psicológicas por violencia familiar y su perspectiva jurídico-social en los Juzgados Penales de la Corte Superior de Justicia de Ica – año 2022, sugiriendo adicionalmente soluciones o alternativas para mitigar la violencia en el ámbito familiar, que pudieran ser aplicados por los órganos jurisdiccionales y para oportunamente el Congreso de la República, de luego de realizar los debates y correcciones que consideren necesarios puedan establecer modificaciones para mitigar la violencia en el ámbito familiar, en la Región Ica, bajo la aplicación de normas de aplicación nacional.

The scientific-legal research subject of study aims to determine the relationship between the crime of psychological injuries due to family violence and its legal-social perspective in the Criminal Courts of the Superior Court of Justice of Ica - year 2022; on which we have analyzed and summarized national and international theses and research works, in which the concern of different researchers regarding the crime of psychological injuries due to family violence is appreciated. The research material of the study is of a basic type, descriptive-correlational design, using the survey or questionnaires as a data collection instrument, which was carried out on 60 people, including public officials, magistrates, lawyers, litigants and people chosen at random, related to the crime of psychological injuries due to family violence and its legal-social perspective in the Criminal Courts of the Superior Court of Justice of Ica - year 2022. Therefore, having carried out a statistical analysis of the aforementioned surveys, it has been determined that the general hypothesis has a perfect positive correlation, where r = 1; as for the specific hypothesis 1 it has a considerable positive correlation, where r = 0.874; the specific hypothesis 2 has a considerable positive correlation, where r = 0.820; and, the specific hypothesis 3 has a considerable positive correlation, where r = 0.785. Additionally, having a legal-legislative contribution, sending a bill to the Ica Bar Association, of which I am an active member, suggesting the researcher regarding the crime of psychological injuries due to family violence and its legal-social perspective in the Criminal Courts of the Superior Court of Justice of Ica - year 2022, additionally suggesting solutions or alternatives to mitigate violence in the family environment, which could be applied by the jurisdictional bodies and for the Congress of the Republic, in a timely manner, after carrying out the debates and corrections they consider necessary, they can establish modifications to mitigate violence in the family environment, in the Ica Region, under the application of nationally applicable regulations.
