Protección Jurídica y Publicidad Registral en Beneficio del Tercero de Buena Fe respecto a la Adquisición de un Bien Inmueble en la Corte Superior de Justicia de Ica en Sede Nasca, 2023

Abstract

Esta investigación se desarrolla sobre el objetivo de determinar las consecuencias de la Protección jurídica y publicidad registral en beneficio del tercero de buena fe respecto a la adquisición de un bien inmueble en la Corte Superior de Justicia de Ica en Sede Nasca, 2023. En la metodología se hace uso de análisis documental, enfoque cualitativo, en diseño de investigación la teoría fundamentada, se hizo uso de grupo de herramientas, parámetros, mecanismos e instrumentos que se utilizan para la obtención de datos y del conocimiento, se hizo uso de la técnica de entrevista y sus instrumentos de guía de entrevista. Alcanzando a los resultados de, algunos especialistas concuerdan en cuanto el objetivo general, la publicidad registral se reconoce como una herramienta valiosa para la protección del tercero de buena fe. La identificación de vacíos legales y las falencias en la información sugieren que es imprescindible implementar prácticas complementarias y fortalecer la regulación existente. Solo así se podrá garantizar una mayor seguridad jurídica en las transacciones inmobiliarias, en relación al objetivo específico 1, las entrevistas indican un consenso sobre la necesidad de establecer medidas cautelares en el ámbito de la prescripción adquisitiva de dominio, pero también subrayan la importancia de implementar estas medidas de forma equilibrada, respetando los derechos de todas las partes y finalmente en relación objetivo específico 2, las entrevistas reflejan una diversidad de opiniones sobre el impacto de la anotación de demanda en los procesos de prescripción adquisitiva de dominio. Si bien hay un consenso sobre la importancia de mantener informadas a las partes y la necesidad de un debido proceso, también se destacan las limitaciones de las medidas cautelares por sí solas

This research is developed with the objective of determining the consequences of Legal Protection and Registry Publicity for the benefit of the third party in good faith regarding the acquisition of real estate in the Superior Court of Justice of Nasca, 2023. The methodology uses documentary analysis, a qualitative approach, grounded theory in research design, a group of tools, parameters, mechanisms and instruments used to obtain data and knowledge, and the interview technique and its interview guide instruments. Reaching the results of, some specialists agree regarding the general objective, registry publicity isrecognized as a valuable tool for the protection of the third party in good faith. The identification of legal loopholes and information deficiencies suggest that it is essential to implement complementary practices and strengthen existing regulation. Only in this way can greater legal security be guaranteed in real estate transactions. In relation to specific objective 1, the interviews indicate a consensus on the need to establish precautionary measures in the area of acquisitive prescription of ownership, but they also underline the importance of implementing these measures in a balanced way, respecting the rights of all parties. Finally, in relation to specific objective 2, the interviews reflect a diversity of opinions on the impact of the annotation of demand in the processes of acquisitive prescription of ownership. Although there is a consensus on the importance of keeping the parties informed and the need for due process, the limitations of precautionary measures alone are also highlighted.
