Percepción de la justicia penal y calidad del Sistema de Justicia en el Módulo Penal Ica, 2024

Abstract

El objetivo planteado fue: determinar a relación entre la percepción de la justicia penal y la calidad del Sistema de Justicia en el módulo penal de Ica, 2024. Ante una metodología que fue de tipo básica, se estableció el uso del cuestionario en términos de la obtención de datos de 69 operadores de justicia. Los resultados indicaron que la percepción de la justicia penal y la calidad del sistema de justicia presentan una relación de 0.835, reflejando la relevancia de la confianza ciudadana en la equidad y eficiencia de los procesos judiciales. La relación entre el marco legal y la calidad del sistema de justicia obtuvo un valor de 0.833, evidenciando la importancia de disposiciones normativas claras para garantizar seguridad jurídica. Asimismo, el marco doctrinario mostró una relación de 0.711 con la calidad del sistema de justicia, ya que la coherencia en la interpretación normativa incide en la legitimidad del sistema. De igual modo, el marco jurisprudencial registró un valor de 0.712, resaltando el papel de la estabilidad de los precedentes en la predictibilidad de las decisiones judiciales. Se ha concluido que la percepción de la calidad del sistema de justicia está determinada por la uniformidad en la aplicación de normas y criterios jurisprudenciales, lo que incide en la confianza ciudadana. La celeridad procesal y la coherencia en la interpretación doctrinal son factores clave en la legitimidad de las decisiones judiciales. La existencia de normas claras y aplicadas de manera consistente favorece la seguridad jurídica, mientras que la falta de criterios uniformes o la presencia de vacíos normativos pueden generar incertidumbre y escepticismo sobre la imparcialidad del sistema judicial.

The objective was to determine the relationship between the perception of criminal justice and the quality of the Justice System in the criminal module of Ica, 2024. Given the basic methodology, the use of the questionnaire was established in terms of obtaining data from 69 justice operators. The results indicated that the perception of criminal justice and the quality of the justice system have a relationship of 0.835, reflecting the relevance of citizen confidence in the equity and efficiency of judicial processes. The relationship between the legal framework and the quality of the justice system obtained a value of 0.833, evidencing the importance of clear normative provisions to guarantee legal certainty. Likewise, the doctrinal framework showed a relationship of 0.711 with the quality of the justice system, since coherence in the normative interpretation affects the legitimacy of the system. Likewise, the jurisprudential framework registered a value of 0.712, highlighting the role of the stability of precedents in the predictability of judicial decisions. It has been concluded that the perception of the quality of the justice system is determined by the uniformity in the application of rules and jurisprudential criteria, which affects citizen confidence. Procedural speed and coherence in doctrinal interpretation are key factors in the legitimacy of judicial decisions. The existence of clear and consistently applied rules favors legal certainty, while the lack of uniform criteria or the presence of regulatory gaps can generate uncertainty and skepticism about the impartiality of the judicial system.
