Aspectos valorativos y subjetivos para regular las consecuencias jurídicas de las familias ensambladas: Ica 2020 – 2021

Abstract

La presente investigación aborda la problemática en que se encuentran inmersas las familias ensambladas, las mismas que han surgido como producto de los cambios sociales, sin embargo, carecen de una normativa que regule sus consecuencias jurídicas. Al formarse este nuevo tipo de familia, sus integrantes desarrollan una serie de lazos de afinidad, así como el desarrollo de los roles paternales, los cuales generan vínculos jurídicos produciéndose derechos, deberes y roles entre sus miembros. Es por ello que el objetivo de esta investigación ha sido analizar aquellos aspectos valorativos, subjetivos y sociales que faciliten su regulación, habiéndose afirmado en que no hay distinción en cuanto a las funciones de la familia tradicional y la familia reconstituida, por lo que el Estado a fin de i garantizar la protección de este tipo de familia, debe reconocerla para que así sus miembros se sientan identificados y a su vez protegidos. La técnica de instrumento de recolección de información aplicada en la investigación es la encuesta, la cual ha sido realizada a jueces, fiscales, abogados y ciudadanos, obteniendo como resultado la urgencia de proteger a los miembros de las familias ensambladas, otorgándoseles el reconocimiento que merecen y brindarles protección jurídica, a fin de asegurar el bienestar y desarrollo integral de la familia. Finalmente, se i concluye que es necesario cubrir el vacío legal, regulando de manera efectiva las consecuencias jurídicas de las familias ensambladas analizadas en la investigación, pues fortalecen los lazos de afinidad entre sus miembros, así como el sentido de pertenencia entre los mismos.

This research addresses the issues faced by blended families, which have emerged as a result of social changes; however, they lack regulations that govern their legal consequences. As this new type of family forms, its members develop a series of bonds of affinity, as well as the development of parental roles, which generate legal ties resulting in rights, duties, and roles among its members. Therefore, the objective of this research has been to analyze those evaluative, subjective, and social aspects that facilitate their regulation, affirming that there is no distinction between the functions of traditional families and reconstituted families. Thus, the State, in order to guarantee the protection of this type of family, must recognize it so that its members feel identified and, in turn, protected.The technique of the information collection instrument applied in the research is the survey, which has been conducted with judges, prosecutors, lawyers, and citizens, resulting in the urgency to protect members of blended families, granting them the recognition they deserve and providing them with legal protection, in order to ensure the well-being and integral development of the family. Finally, it is concluded that it is necessary to fill the legal gap by effectively regulating the legal consequences of the blended families analyzed in the research, as they strengthen the bonds of affinity among their members, as well as the sense of belonging among them.
