Tráfico ilegal de especies y responsabilidad penal del sujeto activo, en la provincia de Ica año 2023

Abstract

La Tesis “TRÁFICO ILEGAL DE ESPECIES Y RESPONSABILIDAD PENAL DEL SUJETO ACTIVO, EN LA PROVINCIA DE ICA AÑO 2023” tuvo como objetivo determinar cómo se relacionan el Tráfico Ilegal de Especies y Responsabilidad Penal del Sujeto Activo en la Provincia de Ica, año 2023. Para la ejecución de la investigación desde el punto de vista normativo se tomaron en cuenta: la Constitución Política del Perú de 1993; la Ley 30220, Ley Universitaria; Estatuto de la UNICA; Código Penal; La Ley N° 29763, que prevé la existencia de un Sistema Nacional de Control y Vigilancia Forestal y de Fauna Silvestre; Resolución Rectoral 029-2021-R, Líneas de Investigación UNICA; Resolución Rectoral 048-2021-R, Reglamento de Grados y Títulos de la UNICA y la Resolución Rectoral 1320-2021-R, Guía para la Elaboración del Proyecto, Informe Final de Tesis UNICA. En el proceso de recolección de datos se recurrió a la Técnica de la Encuesta y los instrumentos de recojo de datos: Cuestionario sobre Tráfico Ilegal de Especies; Cuestionario sobre Responsabilidad penal de Sujeto Activo. De los resultados obtenidos se deduce que entre El Tráfico Ilegal de Especies de Flora y Fauna Silvestre y Responsabilidad Penal del Sujeto Activo que no cuentan con permiso o autorización en la Provincia de Ica, año 2023, se da una relación muy significativa; entre el Tráfico Ilegal de Especies Acuáticas de la Flora y Fauna Silvestre y Responsabilidad Penal del Sujeto Activo que cuentan con permiso o autorización en la Provincia de Ica, año 2023, existe una relación muy estrecha.

The Thesis "ILLEGAL TRAFFICKING OF SPECIES AND CRIMINAL LIABILITY OF THE ACTIVE SUBJECT, IN THE PROVINCE OF ICA YEAR 2023" aimed to determine how the Illegal Trafficking of Species and Criminal Responsibility of the Active Subject in the Province of Ica, year 2023, are related. For the execution of the research from the normative point of view, the following were taken into account: the Political Constitution of Peru of 1993; Law 30220, University Law; Statute of UNICA; Penal code; Law No. 29763, which provides for the existence of a National Forest and Wildlife Control and Surveillance System; Rectoral Resolution 029-2021-R, UNICA Research Lines; Rectoral Resolution 048-2021-R, UNICA Degrees and Degrees Regulations and Rectoral Resolution 1320-2021-R, Guide for the Preparation of the Project, UNICA Final Thesis Report. In the data collection process, the Survey Technique and data collection instruments were used: Questionnaire on Illegal Trafficking of Species; Questionnaire on Criminal Responsibility of Active Subjects. From the results obtained, it can be deduced that between the Illegal Trafficking of Species of Wild Flora and Fauna and Criminal Liability of the Active Subject that do not have a permit or authorization in the Province of Ica, year 2023, there is a very significant relationship; between the Illegal Trafficking of Aquatic Species of Wild Flora and Fauna and Criminal Liability of the Active Subject that have a permit or authorization in the Province of Ica, year 2023, there is a very close relationship.
