Abstract
Para evitar que los niños sufran las consecuencias de la apatridia, es necesario que se les reconozca la ciudadanía del lugar donde nacieron y han residido siempre.
Así se garantiza su bienestar y el de la sociedad, así como el cumplimiento de sus derechos fundamentales, hasta que obtengan una nacionalidad definitiva. Esto se debe hacer conforme al principio del interés superior del niño y al análisis de la apatridia desde el nacimiento o lo antes posible.
Se realizó una investigación básica, no experimental, con el método cuantitativo, para analizar la conexión entre la situación de los menores sin nacionalidad y las deficiencias de las normas jurídicas al respecto.
La muestra estuvo conformada por 103 juristas, a quienes se les observó y encuestó.
El resultado mostró una relación significativa entre las variables estudiadas, con un Chi cuadrado de 91,409 y una significancia bilateral de 0,002.
El propósito del estudio fue conocer el nivel de vinculación entre la problemática de los niños apátridas y los vacíos en las leyes de nacionalidad.
To prevent children from suffering the consequences of statelessness, it is necessary that they be recognized as citizens of the place where they were born and have always resided.
This guarantees their well-being and that of society, as well as the fulfillment of their fundamental rights, until they obtain a definitive nationality. This should be done in accordance with the best interests of the child principle and statelessness analysis from birth or as soon as possible.
A basic, non-experimental research was carried out with the quantitative method, to analyze the connection between the situation of minors without nationality and the deficiencies of the legal norms in this regard.
The sample consisted of 103 lawyers, who were observed and surveyed. The result showed a significant relationship between the variables studied, with a Chi square of 91.409 and a bilateral significance of 0.002.
The purpose of the study was to know the level of link between the problem of stateless children and the gaps in nationality laws.
