Cumplimiento histórico de deberes de la Policía Nacional y ausencia de imputación objetiva en el Perú, Año 2021-2023

Abstract

La tesis titulada “Cumplimiento Histórico de Deberes de la Policía Nacional y Ausencia de Imputación Objetiva en el Perú, 2021-2023”, tuvo por finalidad demostrar la relación que existe entre las variables respecto al accionar de las Fuerzas Policiales de cumplir con su deber y determinar criterios respecto a su actuar si prevalece dentro de los límites del riesgo permitido que lo eximen de responsabilidad penal, lo que engloba dentro de la ausencia de imputación objetiva.

La tesis se ha desarrollado cumpliendo con lo establecido en la R.R. 029-2021-R respecto a la Línea de Investigación, así mismo el R.R. 048-2021-R Reglamento de Grados y Títulos, así como también el R.R. 1320-2021-R Guía para la Elaboración de Tesis. Para desarrollar la investigación que se alcanzó, se recurrió a determinadas Técnicas de Recolección de Datos como la Encuesta, con sus respectivos Instrumentos de Recolección de Datos como fueron el Cuestionario sobre Cumplimiento Histórico de Deberes de la Policía Nacional, Cuestionario sobre Ausencia de Imputación Objetiva, además de llevar a cabo un conjunto de acciones para procesar la información recogida.

Los resultados obtenidos permiten demostrar que, entre el cumplimiento histórico de deberes de la policía nacional pre- republicana y el riesgo permitido de imputación objetiva en el Perú, años 2021-2023, existe una relación muy estrecha; entre el cumplimiento histórico de deberes de la policía nacional republicana y el quebrantamiento de deberes y normas del hombre en el Perú, años 2021-2023, existe una relación muy importante.

The thesis titled “Historical Compliance with Duties of the National Police and Absence of Objective Imputation in Peru, 2021-2023”, aimed to demonstrate the relationship that exists between the variables regarding the actions of the Police Forces to fulfill their duty and determine criteria regarding their actions if they prevail within the limits of the permitted risk that exempt them from criminal responsibility, which falls within the absence of objective imputation.

The thesis has been developed in compliance with the provisions of R.R. 029-2021-R regarding the Line of Research, as well as R.R. 048-2021-R Regulations of Degrees and Degrees, as well as R.R. 1320-2021-R Guide for the Preparation of Thesis.

To develop the research that was achieved, certain Data Collection Techniques were used such as the Survey, with its respective Data Collection Instruments such as the Questionnaire on Historical Compliance with Duties of the National Police, Questionnaire on Absence of Objective Imputation, in addition to carrying out a set of actions to process the information collected.

The results obtained allow us to demonstrate that between the historical fulfillment of duties of the pre-republican national police and the permitted risk of objective imputation in Peru, years 2021-2023, there is a very close relationship; between the historical fulfillment of duties of the national republican police and the breach of duties and norms of man in Peru, years 2021-2023, there is a very important relationship.
