Constitucionalismo Principialista y Neoconstitucionalismo frente al Garantismo Positivista de Luigi Ferrajoli

Abstract

La investigación realizada ha permitido reconocer la estrecha relación que existen entre el constitucionalismo principialista y neo constitucionalismo con el garantismo positivista de Luigi Ferrojoli mediante las Técnicas del Análisis Documental, Encuestas, con el estudio minucioso de la doctrina existente, la consulta a personas conocedoras del Derecho Constitucional se ha podido alcanzar a demostrar las Hipótesis General e Hipótesis Específicas propuestas para la presente Investigación. Los resultados obtenidos con los Instrumentos de Recolección de Datos usados, como fueron la Guía de Análisis Documental, el Cuestionario sobre constitucionalismo principalista y neoconstitucionalismo, Cuestionario sobre el Garantismo Positivista de Luigi Ferrojoli han permitido demostrar la relación existente entre las variables del estudio realizado. Este trabajo es, en su mayor parte, una Investigación Dogmática desde su relación con el Derecho, pero, desde la Metodología de la Investigación también coincide con una investigación de nivel descriptivo, el Diseño empleado ha sido el Descriptivo Correlacional, ya que a lo largo de su desarrollo se ha buscado establecer la relación entre las variables: constitucionalismo principalista y neoconstitucionalismo con el garantismo positivista de Luigi Ferrojoli.

The research carried out has allowed to recognize the close relationship that exist between principalist constitutionalism and neoconstitutionalism with the positivist guarantees of Luigi Ferrojoli, through the Techniques of Documentary Analysis, Survey has been able with the thorough study of the existing doctrine, the consultation of people who know of the Constitutional Law to achieve has demonstrated the General Hypotheses and Specific Hypotheses proposed for this Research. The results obtained with the Data Collection Instruments used, such as the Documentary Analysis Guide, the Questionnaire on Principalist Constitutionalism and Neoconstitutionalism, Questionnaire on the Positivist Garantism of Luigi Ferrojoli have shown the relationship between the variables of the study carried out. This work is for the most part a Dogmatic Investigation since its relationship with Law, but, since the Research Methodology also coincides with a descriptive level investigation, the Design employed has been the Descriptive Correlation, since throughout its development has sought to establish the relationship between the variables: principalist constitutionalism and neoconstitutionalism with the positivist guarantee of Luigi Ferrojoli.
