Resumen
El estudio “El problema de la coautoría y el grado de participación de cada imputado, en el distrito de Ica - 2023”
agenció establecer la problemática más frecuente de la coautoría en relación con el
grado de participación de cada imputado en el distrito de Ica, año 2023, de igual manera
determinar si es posible sancionar a través de la coautoría actos ilícitos no sujetos a
acuerdo previo en la ejecución del delito y entre simplicidad procesal y determinar si el
reparto de roles de la coautoría para la ejecución del delito comprende conductas ilícitas
acordadas o también acciones ilícitas adicionales para la concretización del delito.
Proponiendo como hipótesis general: La problemática más frecuente es la
indeterminación del correcto grado de participación de los acusados, lo cual impide una
correcta determinación de la sanción a imponerse, lo que conlleva a la imposición de
sanciones muchas veces subjetivas e injustas en el distrito de Ica, año 2023.
Siendo un tipo de investigación pura, nivel correlacional y diseño transversal,
correlacional y no experimental. Ejecutándose el cuestionario a 158 personas entre ellos
fiscales, jueces y defensores penalistas, alcanzando productos fidedignos.
De los productos alcanzados se consiguió establecer la problemática más
frecuente de la coautoría en relación con el grado de participación de cada imputado,
siendo estos compilados a través de cuadros estadísticos acompañados al presente
informe final.
The study "The problem of co-authorship and the degree of participation of each defendant in the district of Ica - 2023" aimed to establish the most frequent problem of co-perpetration in relation to the degree of participation of each defendant in the district of Ica, year 2023, likewise, to determine if it is possible to punish through co-perpetration illicit acts not subject to prior agreement in the execution of the crime and between procedural simplicity and to determine if the distribution of roles of co-perpetration for the execution of the crime includes agreed illicit conducts or also additional illicit actions for the realization of the crime. Proposing as a general hypothesis: The most frequent problem is the indetermination of the correct degree of participation of the accused, which prevents a correct determination of the sanction to be imposed, which leads to the imposition of often subjective and unjust sanctions in the district of Ica, year 2023. It is a pure research type, correlational level and cross-sectional, correlational and non-experimental design. The questionnaire was carried out with 158 people, including prosecutors, judges and criminal defense attorneys, achieving reliable products. From the results obtained, it was possible to establish the most frequent problems of co-perpetration in relation to the degree of participation of each defendant, which are compiled in the statistical tables attached to this final report.
