Resumen
Objetivo: Conocer la aplicación de las medidas de protección en casos de violencia familiar del juzgado de familia transitorio de la provincia de Ica en el 2023.
Metodología: El diseño es de tipo descriptivo, observacional y tipo retrospectivo.
Resultados: “Se analizaron 604 expedientes. Donde se determinó que el tipo de violencia familiar más frecuente es la psicológica 496 (82.1%). Otros tipos de violencia familiar fueron la física 199 (32.9%), sexual 43 (7.1%) y económica 64 (10.6%). La medida de protección más frecuente es el retiro de del agresor del domicilio en 580 (96%). Así mismo, las otras medidas de protección fueron el impedimento de proximidad o de acercamiento a la víctima en 425 (70.4%), prohibición de comunicación con la víctima vía telefónica, epistolar, electrónica, mediante redes sociales, vía chat, red institucional, intranet u otras redes o formas de comunicación se indicó en 403 (66.8%), prohibición del derecho de porte de armas y tenencia por el agresor 31 (5.1%) y el inventario sobre sus bienes se indicó en 9 (1.5%). Se otorgó medidas de protección en 477 (79%) y no se consideró en 127 (21%). El riesgo de violencia familiar más frecuente fue el riesgo moderado 273 (45.2%). De igual manera, se encontró que el riesgo leve 190 (31.5%) y el riesgo severo fue 141 (23.3%). El integrante del grupo familiar agraviado más frecuente es la mujer 494 (81.8%)”.
Conclusión: Se otorgó medidas de protección en porcentajes más altos respecto a otros estudios.
Objective: To know the application of protection measures in cases of family violence of the transitional family court of the province of Ica in 2023. Other types of family violence were physical 199 (32.9%), sexual 43 (7.1%) and economic 64 (10.6%). The most frequent protection measure is the removal of the aggressor from the home in 580 (96%). Likewise, the other protective measures were the prohibition of proximity or approach to the victim in 425 (70.4%), prohibition of communication with the victim by telephone, letter, electronic, through social networks, vía chat, institutional network, intranet or other networks or forms of communication was indicated in 403 (66.8%), prohibition of the right to carry and possess weapons by the aggressor in 31 (5.1%) and the inventory of their assets was indicated in 9 (1.5%). Protective measures were granted in 477 (79%) and were not considered in 127 (21%). The most frequent risk of family violence was moderate risk in 273 (45.2%). Likewise, it was found that the mild risk was 190 (31.5%) and the severe risk was 141 (23.3%). The most frequent member of the aggrieved family group is the woman 494 (81.8%)”. Conclusion: Protective measures were granted in higher percentages than in other studies.
