Seguridad jurídica de derecho real no inscrito frente a un derecho inscrito y su implicancia en el derecho a la propiedad en los registros públicos de la provincia]a de Ica,2021.

Abstract

En esta oportunidad pasamos a manifestar que, si bien es cierto que los registros públicos revisten de importancia, ya que tiene la misión de realizar todos los actos administrativos que por mandato legal le faculta para que pueda registrar los actos de compra-venta y poder así resolver cualquier controversia de carácter patrimonial, por supuesto que ello obedece a la solicitud de una de las partes sobre los bienes que ostentan y poder así contar con la protección jurídica. Todo ello, con la finalidad de dar una verdadera seguridad jurídica a los derechos reales, las mismas que por cualquier circunstancia no han sido inscritos y se encuentran en conflicto con otros derechos inscritos, así como también tratar algunas implicancias en cuanto a su derecho a la propiedad los actos administrativos tramitados por ante los registros públicos de la provincia de Ica. En este orden de ideas, estamos en condiciones señalar que es necesario establecer una serie de mecanismos jurídicos que permitan buscar una solución loable, célere y oportuna a fin de establecer soluciones a los propietarios que se sienten afectados por la doble inscripción podemos indicar que con ello lo que se busca es que frene el avance de la doble inscripción de un mismo bien inmueble.

On this occasion we proceed to state that, although it is true that public registries are important, since they have the mission of carrying out all the administrative acts that by legal mandate empower them to register the acts of purchase-sale and thus be able to resolve any patrimonial dispute, of course this obeys the request of one of the parties regarding the assets they hold and thus be able to have legal protection. All this, with the purpose of giving true legal security to real rights, the same ones that for any reason have not been registered and are in conflict with other registered rights, as well as dealing with some implications regarding their right to property, the administrative acts processed before the public registries of the province of Ica. In this order of ideas, we are in a position to point out that it is necessary to establish a series of legal mechanisms that allow us to find a laudable, fast and timely solution in order to establish solutions for the owners who feel affected by the double registration. We can indicate that what is sought is to stop the advance of the double registration of the same real estate.
