Eficacia de las medidas de protección otorgadas a las víctimas por violencia familiar, en el distrito de Ica 2023

Abstract

Objetivo: Explicar cuál sería la eficacia que se darían en las MP que logran ser otorgadas a las víctimas por VF en el distrito de Ica, 2023. Metodología: al realizar la aplicación de una investigación con un nivel de carácter descriptivo y de también de carácter explicativo, además de un método de carácter hipotético y sobre todo deductivo, agregando un diseño no experimental y transeccional, donde se decidió como muestra sea una conformación de 100 abogados con especialidad en el cual se seleccionó la materia mediante el muestreo censal. En esta oportunidad se realizó la aplicación de la técnica muy referencial y objetiva de la encuesta, asimismo la aplicación de su correspondiente instrumento como es la del cuestionario con una confiabilidad de 79% según valor obtenido mediante Alfa de Cronbach. Resultados: Las MP (79%) y la VF (68%) son nivel regular. Siendo la del retiro de domicilio la medida más eficaz (70%). Asimismo, las medidas del juez tienen mayor eficacia que las dictaminadas por el fiscal (24%) y el no cumplimiento de aquellas hace que los agresores reincidan en la violencia familiar(VF) (30%). La violencia a nivel familiar más frecuente fue violencia psicológica (65%) y los especialistas señalan que la protección del juez no es eficaz para brindar las medidas correspondientes a la protección ya sea del bienestar y/o salud física u otras (61%); hallándose que la gran mayor frecuencia de violencia se evidencia en los convivientes, entonces a mayor vínculo familiar será menor la demostración de eficacia presentada por las otorgadas medidas. Conclusión: Existe un 9.2% de eficacia que generen las MP otorgadas a las agredidas. Mientras que las MP ya sean para cualquier tipo de violencia ejercida a nivel familiar son eficaces en solo un 31.8%. Finalmente, las MP podrían garantizar su eficacia en las víctimas de VF que son vulneradas en algún vínculo familiar(VF) en solo el 1%.

Objective: Explain what would be the effectiveness of the MP that can be granted to victims of VF in the district of Ica, 2023. Methodology: by carrying out the application of an investigation with a descriptive and explanatory level of character, in addition to a hypothetical and above all deductive method, adding a non-experimental and cross-sectional design, where the sample was decided to be a composition of 100 lawyers with a specialty in which the subject was selected through census sampling. On this occasion, the very referential and objective technique of the survey was applied, as well as the application of its corresponding instrument such as the questionnaire with a reliability of 79% according to the value obtained using Cronbach's Alpha. Results: The MP (79%) and the VF (68%) are regular level. The removal from home being the most effective measure (70%). Likewise, the judge's measures are more effective than those ordered by the prosecutor (24%), and failure to comply with them causes the aggressors to repeat domestic violence (DV) (30%). The most frequent type of domestic violence was psychological violence (65%), and specialists point out that the judge's protection is not effective in providing the corresponding measures for protection of well-being and/or physical health or other factors (61%). They found that the greatest frequency of violence is evident in cohabitants; therefore, the stronger the family ties, the lower the demonstration of effectiveness presented by the measures granted. Conclusion: The DV granted to the victims is 9.2% effective. DV for any type of domestic violence is effective in only 31.8%. Finally, DV could guarantee its effectiveness in victims of DV whose family ties are violated in only 1%.
