La tenencia compartida frente al interés superior del niño en el distrito judicial de Ica, 2024

Abstract

La investigación identificó como principal problema de estudio ¿De qué manera la tenencia compartida se relaciona con el interés superior del niño en el Distrito Judicial de Ica, 2024?, a razón de ello, se estableció como principal objetivo: Determinar cómo la tenencia compartida se relaciona con el interés superior del niño en el Distrito Judicial de Ica, 2024. Con respecto a la metodología se empleó un enfoque cualitativo, de tipo básico, nivel descriptivo y diseño no experimental, tanto la población como muestra de estudio estuvo comprendida por 3 abogados y 4 jueces participando de la investigación a través del llenado de una guía de entrevista. Los resultados demostraron que, la tenencia compartida, cuando se aplica correctamente y en contextos familiares favorables se alinea con el interés superior del niño permitiendo que ambos padres participen de forma activa en su crianza. No obstante, su implementación debe ser cuidadosamente evaluada caso por caso considerando el nivel de cooperación entre los progenitores, estabilidad del entorno y opinión del propio niño.

The research identified the main problem of study as: How does shared custody relate to the best interests of the child in the Judicial District of Ica, 2024? Therefore, the main objective was established: To determine how shared custody relates to the best interests of the child in the Judicial District of Ica, 2024. Regarding the methodology, a qualitative approach was used, with a basic, descriptive level and non-experimental design. Both the population and the study sample consisted of three lawyers and four judges who participated in the research by completing an interview guide. The results demonstrated that shared custody, when applied correctly and in favorable family contexts, is aligned with the best interests of the child, allowing both parents to actively participate in their upbringing. However, its implementation must be carefully evaluated on a case-by-case basis, considering the level of cooperation between the parents, the stability of the environment, and the child's own opinion.
