Regulación jurídica de la familia homoparental y su influencia en la protección del interés superior del niño, Ica 2023

Abstract

Las familias homoparentales son aquellas conformadas por dos personas del mismo sexo que desean hacer vida en común, sin embargo, dentro del ordenamiento jurídico civil de nuestro país no existe una alusión clara hacia sus derechos, sin embargo, desde la propia Constitución y pronunciamientos del propio Tribunal Constitucional se hace una continua mención a la nueva concepción de familia, enfatizando que esta debe entenderse de forma extensiva, es decir, reconociendo que existen varios tipos de familia y que es deber del Estado, por mandato del artículo 4° de la Constitución el protegerlas. Aun así, en el desarrollo de esos pronunciamientos se hace alusión a la familia ensamblada, reconstituida, monoparental o a la propia convivencia, pero no se hace alusión a la familia homoparental situación que es bastante común en nuestra región, salvo el caso de Colombia cuya Corte Constitucional cuenta con fallos positivos al respecto, debido a razones que van desde una interpretación histórica del concepto de familia hasta el simple prejuicio o estigmatización de este tipo de personas, con lo que se vulneran sus derechos fundamentales tal como ya ha señalado la Corte Interamericana de Derechos Humanos en una de sus opiniones consultivas. En esa línea conviene analizar las consecuencias de esta forma de tratamiento a esta figura familiar cuando se cuenta con menores de edad, realidad concreta y corroborada mediante estudios sobre familias homoparentales realizados recientemente donde se señala que 4 de cada 10 participantes tienen al menos un hijo, el 66% de familias cuentan con hijos concebidos en una relación diversa y el 62% de familias con hijos quisieran tener otros más, asimismo más de la mitad de los hijos fue concebido por fecundidad asistida, mientras que de esa cantidad el 74% uso este método en Perú y el 20% en el extranjero, en tanto, sobre la cobertura de salud, refiere el 47% de encuestados que ninguno de sus hijos cuenta con seguro público y el 36% afirma que tampoco cuenta con un seguro particular, finalmente, sobre el matrimonio, el 18% manifiesta estar en una contienda legal para reconocer en el Perú su matrimonio celebrado fuera del país, mientras que el 96% desea registrar su matrimonio en el país. A la luz de esa data se revela un problema público consistente en el necesario tratamiento legal de la familia homoparental y, cómo no, los efectos que ello trae consigo al superior interés del niño quien puede ver limitado sus derechos (salud o derechos patrimoniales, por ejemplo), debido a una interpretación errónea del concepto familia.

Along these lines, it is convenient to analyze the consequences of this form of treatment of this family figure when there are minors, a concrete reality corroborated by studies on homoparental families carried out recently where it is indicated that 4 out of every 10 participants have at least one child, 66% of families have children conceived in a diverse relationship and 62% of families with children would like to have more.
