Ampliación de Sucesión Intestada y la Inclusión de Herederos Preteridos como Asunto Notarial no Contencioso, en la Notaría Flores Quille, Ica, 2022

Abstract

El estudio buscó determinar la relación entre la ampliación de sucesión intestada y la inclusión de herederos preteridos como asunto notarial no contencioso, en la Notaría Flores Quille, Ica, 2022. Asimismo, correspondió a una investigación básica, cuantitativa y correlacional, que manifestó un diseño no experimental, conformando la muestra por 01 notario y 20 abogados, aplicando la encuesta. Además, los resultados indicaron que 74.2% calificó la extensión de la sucesión intestada en tendencia media y 16.1% en nivel alto, de igual manera, 77.4% calificó la inclusión de herederos preteridos en nivel medio y 12.9% en nivel alto, así como se identificó que la dimensión sucesión intestada vía notarial estuvo significativamente relacionada con la inclusión de herederos preteridos por medio de sigma=0. Con un coeficiente de 0,728, se observó una asociación positiva considerable en la sucesión intestada por vía judicial, que se relacionó significativamente con la inclusión de herederos preteridos (sigma=0,000) y un coeficiente de 0,833, lo que reveló una asociación positiva muy fuerte. En conclusión, la extensión de la sucesión intestada se relacionó significativamente con la inclusión de herederos preteridos (sigma=0,000) y, con un valor de 0,838, se evidenció una asociación positiva muy fuerte. The study sought to determine the relationship between the extension of intestate succession and the inclusion of pretermitted heirs as a non-contentious notarial matter, in the Flores Quille Notary Office, Ica, 2022. Likewise, it corresponded to a basic, quantitative, correlational research, which manifested a non-experimental design, conforming the sample by 01 notary and 20 lawyers, applying the survey. In addition, the results indicated that 74.2% rated the extension of intestate succession at medium tendency and 16.1% at high level, likewise, 77.4% rated the inclusion of pretermitted heirs at medium level and 12.9% at high level, likewise, it was identified that the dimension intestate succession via notary was significantly related to the inclusion of pretermitted heirs by means of sigma=0. 000 and with coefficient 0.728 showed a considerable positive association, while, intestate succession via judicial was significantly related to the inclusion of pretermitted heirs by sigma=0.000 and with coefficient 0.833 revealed a very strong positive association. In conclusion, the extension of intestate succession was significantly related to the inclusion of pretermitted heirs through the sigma=0.000, and with the value of 0.838, a very strong positive association was evidenced.
