Desnaturalización de la figura de la Reserva Provisional de la Investigación frente a su interpretación errónea en el Distrito Fiscal de Ica, año 2023

Abstract

La presente tesis titulada “Desnaturalización de la figura de la Reserva Provisional de la Investigación frente a su interpretación errónea en el Distrito Fiscal de Ica, año 2023”. tuvo como objetivo determinar en qué medida se desnaturaliza la figura de la reserva provisional de la investigación por su interpretación errónea. Esta investigación se realizó con un enfoque cuantitativo, alcance explicativo y diseño explicativo observacional y no experimental, ya que no manipuló las variables, y así de esa forma explicar, ¿En qué medida se desnaturaliza la figura de la reserva provisional de la investigación por su interpretación errónea de parte de los fiscales en el distrito fiscal de Ica?, utilizando una investigación de nivel explicativo. El estudio se basó en el método científico, especialmente el hipotético deductivo. El trabajo analizó una población conformada por fiscales (18), y profesionales del derecho (80), obtenidos desde su totalidad poblacional. Los resultados fueron validados mediante el Alpha de Cronbanch, como una medida estadística utilizada para evaluar la confiabilidad interna de un conjunto de preguntas o ítems del cuestionario aplicado. This thesis, entitled “Distortion of the Provisional Investigation Reserve Concept Due to its Erroneous Interpretation in the Ica Judicial District, 2023,” aimed to determine the extent to which the provisional investigation reserve concept is distorted by its erroneous interpretation. This research employed a quantitative approach, an explanatory scope, and an observational, non-experimental design, as it did not manipulate variables. The study sought to explain the extent to which the provisional investigation reserve concept is distorted by its erroneous interpretation by prosecutors in the Ica Judicial District, using an explanatory level of research. The study was based on the scientific method, specifically the hypothetico-deductive method. The study analyzed a population comprised of prosecutors (18) and legal professionals (80), obtained from the entire population. The results were validated using Cronbach's alpha, a statistical measure used to evaluate the internal reliability of a set of questions or items in the applied questionnaire.
