Las medidas cauterales y su aplicación maliciosa en los procesos constitucionales en el distrito judicial de Ica, año 2024

Abstract

El trabajo de investigación, materia de análisis, se desarrolla en el ámbito científico-jurídico con el objeto de establecer la relación existente entre las medidas cautelares y su aplicación maliciosa en los procesos constitucionales en el Distrito Judicial de Ica, año 2024; ejecutándose para ello una exhaustiva búsqueda bibliográfica, respecto a la parte conceptual, dogmática y tesis nacionales e internacionales, que coincidieron con el tema a desarrollar. La investigación por el objeto, su tipo es básica, aplicándose un diseño descriptivo- correlacional, para lo cual se ha utilizado como principal herramienta de acopio de datos a la encuesta, elaborada y monitoreada para ser ejecutada 60 personas aleatoriamente, sobre los cuales se destaca la participación de funcionarios y servidores judiciales, así como abogados especialistas, de litigantes, como personas que amablemente aceptaron responder las interrogantes, ello en el desarrollo de la tesis titulada: “Las medidas cautelares y su aplicación maliciosa en los procesos constitucionales en el Distrito Judicial de Ica, año 2024”. Que, para obtener los resultados de la investigación, se ha recurrido a los programas estadísticos necesarios, determinándose que para la hipótesis general, existe una correlación positiva media, donde r = 0,739; en cuanto a la hipótesis específica 1, existe una correlación positiva considerable, donde r = 0,765; la hipótesis específica 2, existe una correlación positiva media, donde r = 0,739; y, la hipótesis específica 3, existe una correlación positiva media, donde r = 0,739. Consecuentemente, hemos estimado para los fines y mejor desarrollo de la actividad jurídica, proponer por ante el Ilustre Colegio de Abogados de Ica, un proyecto de ley para mejorar ostensiblemente la problemática sobre las medidas cautelares y su aplicación maliciosa en los procesos constitucionales en el Distrito Judicial de Ica; ya que hemos advertido que el juez dentro del ámbito del proceso constitucional goza de facultades correctivas o sancionadoras ante la presentación de medidas cautelares maliciosas, no obstante debe establecerse de manera expresa que deben sancionarse a los abogados y litigantes que presenten este tipo de pedidos, conociendo su carácter ilegítimo o ilegal.

The research work under analysis is developed within the scientific-legal field with the objective of establishing the relationship between precautionary measures and their malicious application in constitutional proceedings in the Judicial District of Ica, in 2024. To this end, an exhaustive bibliographic search was conducted, examining the conceptual and doctrinal aspects, as well as national and international theses, that coincided with the topic under development. The research, by its nature, is basic in nature, employing a descriptive-correlational design. The primary data collection tool was a survey, designed and monitored, which was administered to 60 randomly selected individuals. These participants included judicial officials and staff, as well as specialist lawyers, litigators, and other individuals who kindly agreed to answer the questions. This was all part of the development of the thesis entitled: “Precautionary Measures and Their Malicious Application in Constitutional Proceedings in the Judicial District of Ica, 2024.” In order to obtain the results of the investigation, the necessary statistical programs have been used, determining that for the general hypothesis, there is a medium positive correlation, where r = 0.739; as for specific hypothesis 1, there is a considerable positive correlation, where r = 0.765; for specific hypothesis 2, there is a medium positive correlation, where r = 0.739; and for specific hypothesis 3, there is a medium positive correlation, where r = 0.739. Consequently, for the purposes and better development of legal activity, we have deemed it necessary to propose to the Illustrious Bar Association of Ica a bill to significantly improve the situation regarding precautionary measures and their malicious application in constitutional proceedings in the Judicial District of Ica. Since we have noted that the judge within the scope of the constitutional process enjoys corrective or sanctioning powers in the face of the presentation of malicious precautionary measures, it must be expressly established that lawyers and litigants who present this type of request, knowing its illegitimate or illegal nature, must be sanctioned.
