La perennización, disposición y cadena de custodia en los elementos materiales del delito en la función de investigación fiscal para su utilización en la acreditación de hechos en el juicio oral, Ica - 2021

Abstract

El presente trabajo de investigación titulado “La perennización, disposición y cadena de custodia en los elementos materiales del delito en la función de investigación fiscal para su utilización en la acreditación de hechos en el juicio oral, Ica– 2021”; estableció como objetivo general determinar el tratamiento de perennización, disposición y cadena de custodia en los elementos materiales del delito en la función de investigación fiscal para su utilización en la acreditación de hechos en el juicio oral.; como objetivos específicos, se estableció analizar cuál es la naturaleza de los elementos materiales en la investigación de los delitos; establecer qué tratamiento les dan los operadores fiscales a los elementos materiales del delito en la investigación penal.; determinar cómo se ofrecen y actúan los elementos materiales del delito para acreditar los hechos imputados en juicio oral; y verificar cómo se pueden perennizar los elementos materiales del delito para ser eficaces en la acreditación del hecho imputado en juicio oral. Con respecto a la metodológica, se trabajó en base a un enfoque cualitativo, basado en la teoría fundamentada, como instrumento de recolección de datos se utilizó la guía de entrevista; técnica la entrevista, conformada por 11 preguntas abiertas, elaboradas en base a los objetivos planteados, arribando a la conclusión que el tratamiento de perennización, disposición y cadena de custodia de los elementos materiales del delito es fundamental en la investigación fiscal, debido a que, permite al fiscal acreditar los hechos en el juicio oral; por ello, es imperativo que este tratamiento se ajuste estrictamente a lo establecido en el Reglamento de la Cadena de Custodia, asegurando que las pruebas no se alteren ni se contaminen, manteniendo así su valor probatorio; de no cumplirse con estos protocolos, los elementos materiales no podrán ser admitidos ni valorados en el juicio oral, comprometiendo la eficacia del proceso penal.

The present research work entitled “The perennialization, disposition and chain of custody in the material elements of the crime in the fiscal investigation function for its use in the accreditation of facts in the oral trial, Ica- 2021”; established as general objective to determine the treatment of perennialization, disposition and chain of custody in the material elements of the crime in the fiscal investigation function for its use in the accreditation of facts in the oral trial. The specific objectives were to analyze the nature of the material elements in the investigation of crimes; to establish how prosecutors treat the material elements of the crime in the criminal investigation; to determine how the material elements of the crime are offered and used to prove the facts charged in the oral trial; and to verify how the material elements of the crime can be perpetuated to be effective in proving the facts charged in the oral trial. With respect to the methodology, we worked on the basis of a qualitative approach, based on grounded theory, the interview guide was used as an instrument of data collection; the interview technique, made up of 11 open questions, elaborated based on the stated objectives, arriving at the conclusion that the treatment of perennialization, disposition and chain of custody of the material elements of the crime is fundamental in the prosecutorial investigation, because it allows the prosecutor to prove the facts in the oral trial; Therefore, it is imperative that this treatment be strictly adjusted to the provisions of the Chain of Custody Regulations, ensuring that the evidence is not altered or contaminated, thus maintaining its probative value; if these protocols are not complied with, the material elements may not be admitted or valued in the oral trial, compromising the effectiveness of the criminal process.
