El nivel de corrupción en el sistema penal y la eficacia de la persecución del crimen organizado en el distrito fiscal de Ica, periodo 2023-2024

Abstract

La tesis titulada “EL NIVEL DE CORRUPCIÓN EN EL SISTEMA PENAL Y LA EFICACIA DE LA PERSECUCIÓN DEL CRIMEN ORGANIZADO EN EL DISTRITO FISCAL DE ICA, PERIODO 2023–2024” tuvo como propósito principal determinar la relación existente entre el nivel de corrupción en el sistema penal y la eficacia de la persecución del crimen organizado en dicho ámbito territorial. Para su elaboración, se consideraron los marcos normativos pertinentes, entre ellos: la Constitución Política del Perú de 1993, la Ley N.° 30220, Ley Universitaria, el Estatuto de la Universidad Nacional San Luis Gonzaga (UNICA), la normatividad penal y procesal penal vigente, así como las Resoluciones Rectorales N.° 029-2021-R (Líneas de Investigación UNICA), N.° 048-2021-R (Reglamento de Grados y Títulos de la UNICA) y N.° 1320-2021-R (Guía para la Elaboración del Proyecto e Informe Final de Tesis). En la fase de recolección de datos se aplicó la técnica de la encuesta, utilizando como instrumentos los cuestionarios sobre el nivel de corrupción en el sistema penal y la eficacia en la persecución del crimen organizado. Los resultados obtenidos evidencian que un mayor nivel de corrupción dentro del sistema penal incide de manera significativa y negativa en la eficacia de la persecución del crimen organizado en el Distrito Fiscal de Ica durante el periodo 2023–2024.

The thesis entitled “The Level of Corruption in the Criminal Justice System and the Effectiveness of Organized Crime Prosecution in the Ica Fiscal District, 2023–2024” aimed to determine the relationship between the level of corruption in the criminal justice system and the effectiveness of organized crime prosecution in that jurisdiction. For its development, the relevant regulatory frameworks were considered, including: the 1993 Political Constitution of Peru, Law No. 30220, the University Law, the Statutes of the National University of San Luis Gonzaga (UNICA), current criminal and criminal procedure regulations, as well as Rectoral Resolutions No. 029-2021-R (UNICA Research Lines), No. 048-2021-R (UNICA Degree and Title Regulations), and No. 1320-2021-R (Guide for the Development of the Thesis Project and Final Report). In the data collection phase, the survey technique was applied, using questionnaires on the level of corruption in the criminal justice system and the effectiveness of prosecuting organized crime as instruments. The results obtained show that a higher level of corruption within the criminal justice system has a significant and negative impact on the effectiveness of the prosecution of organized crime in the Ica Fiscal District during the period 2023–2024.
