Prisión preventiva y su influencia en la vulneración del principio de inocencia en el Poder Judicial de la Provincia de Ica, año 2022

Abstract

La intención de la investigación resultó ser determinar la influencia de la prisión preventiva y la vulneración del principio de inocencia, Poder Judicial Provincia de Ica, 2022. La metodología fue de tipo básica y correlacional, teniendo un tamaño muestral de 78 operadores de justicia, en donde los datos fueron obtenidos por el empleo del cuestionario. Los resultados indicaron que existió una relación de 0.736 entre la restricción de libertad sin sentencia y el resguardo de garantías fundamentales, evidenciándose, cómo esta medida puede alterar el estatus jurídico antes del fallo definitivo. Se reportó, además, una relación de 0.565 al considerar el peso de las pruebas en la valoración judicial y de 0.822 en la evaluación del riesgo procesal sobre el derecho a ser considerado inocente. Se ha concluido que el uso de medidas restrictivas previas al juicio, la valoración insuficiente de evidencias y un análisis inadecuado del riesgo procesal tienden a afectar la protección efectiva del derecho a la presunción de inocencia, por lo que se vuelve indispensable fortalecer los criterios y procedimientos que garanticen la imparcialidad y el debido proceso en cada etapa judicial.

The intention of the investigation turned out to be to determine the influence between pretrial detention and the violation of the principle of innocence in the Judicial Branch of the Province of Ica, year 2022. The methodology was basic and correlational, with a sample size of 78 justice operators, where the data were obtained by using the questionnaire. The results indicated that there was a relationship of 0.736 between the restriction of liberty without a sentence and the protection of fundamental guarantees, showing how this measure can alter the legal status before the final ruling. In addition, a ratio of 0.565 was reported when considering the weight of evidence in the judicial assessment and 0.822 in the assessment of procedural risk on the right to be considered innocent. It has been concluded that the use of restrictive pre-trial measures, insufficient evaluation of evidence, and inadequate analysis of procedural risk tend to affect the effective protection of the right to the presumption of innocence, so it is essential to strengthen the criteria and procedures that guarantee impartiality and due process at each judicial stage.
