Derecho a la protesta y situación socio-política del Perú al 2023: mirada desde el derecho constitucional

Abstract

La tesis titulada “DERECHO A LA PROTESTA Y SITUACIÓN SOCIO POLÍTICA DEL PERÚ AL 2023: MIRADA DESDE EL DERECHO CONSTITUCIONAL”, tuvo por finalidad demostrar la relación que existe entre las variables en estudio. Se ha realizado considerando la Constitución Política del Perú de 1993; la Ley 30220, Ley Universitaria, Normas Legales del Derecho Constitucional, el Estatuto de la UNICA, la Resolución Rectoral 029-2021-R, Líneas de Investigación de la UNICA, así mismo la Resolución Rectoral 048-2021-R, Reglamento de Grados y Títulos, asimismo la Resolución Rectoral 1320-2021-R, Guía para la Elaboración de Tesis. Para desarrollar la investigación que se alcanza, se recurrió a determinadas Técnicas de Recolección de Datos como la Encuesta, el Análisis Documental, con sus respectivos Instrumentos de Recolección de Datos como fueron el Cuestionario sobre Derecho a la Protesta, la Ficha de Análisis Documental sobre situación socio-política, además de llevar a cabo un conjunto de acciones para procesar la información recogida. Los resultados obtenidos permiten demostrar que entre la protesta en espacios públicos y situación social en el Perú al año 2023, se da una relación muy significativa; entre la realización de Asambleas Populares y la situación política en el Perú al año 2023, se da una relación muy estrecha.

The thesis entitled "RIGHT TO PROTEST AND SOCIO-POLITICAL SITUATION OF PERU TO 2023: VIEW FROM CONSTITUTIONAL LAW", aimed to demonstrate the relationship that exists between the variables under study. It has been carried out considering the Political Constitution of Peru of 1993; Law 30220, University Law, Legal Norms of Constitutional Law, the Statute of UNICA, Rectoral Resolution 029-2021-R, UNICA Research Lines, as well as Rectoral Resolution 048-2021-R, Regulation of Degrees and Degrees, as well as Rectoral Resolution 1320 2021-R, Guide for the Preparation of Theses. To develop the research that is achieved, certain Data Collection Techniques were used, such as the Survey, the Documentary Analysis, with their respective Data Collection Instruments such as the Questionnaire on the Right to Protest, the Documentary Analysis File on the socio-political situation, in addition to carrying out a set of actions to process the information collected. The results obtained allow us to demonstrate that there is a very significant relationship between protest in public spaces and the social situation in Peru by 2023; between the holding of Popular Assemblies and the political situation in Peru by 2023, there is a very close relationship.
