Resumen
El trabajo de investigación titulado "Análisis de la buena fe negocial y su relación con la
efectividad de las negociaciones colectivas en el Gobierno Regional de Ica periodo 2016 – 2019"
aborda la influencia de la buena fe negocial en el proceso de negociación colectiva, con el objetivo
de analizar esta influencia y sus manifestaciones en dicho procedimiento. Se plantea que la buena
fe negocial, representada como variable independiente, afecta la negociación colectiva,
considerada como variable dependiente.
El estudio identifica la buena fe negocial como esencial para el éxito de las negociaciones
colectivas, evidenciando su importancia en la percepción de los participantes y su impacto
positivo en los resultados. Se destaca la transparencia, el compromiso genuino y la búsqueda de
soluciones mutuamente beneficiosas como elementos clave para construir confianza y facilitar un
diálogo constructivo entre las partes.
Asimismo, se concluye que el esfuerzo genuino y leal de las partes en el proceso de negociación
colectiva contribuye positivamente al logro de acuerdos beneficiosos para ambas partes. La
preparación adecuada, el intercambio de información relevante y el compromiso con el
cumplimiento de los acuerdos se identifican como indicadores de un enfoque de buena fe que
mejora la efectividad y equidad del proceso de negociación.
La constatación del respeto al principio de buena fe negocial se refleja en la transparencia,
comunicación abierta, compromiso con los acuerdos y búsqueda de soluciones mutuamente
beneficiosas. Además, se evidencia una vulneración significativa del derecho de los trabajadores
a una negociación colectiva plena en el sector estatal, debido a limitaciones en las condiciones
económicas contempladas por la Ley N° 31188.
En cuanto a las recomendaciones, se sugiere fortalecer las prácticas de buena fe negocial mediante
la formación y capacitación de los participantes, estableciendo mecanismos de seguimiento y
evaluación de los acuerdos alcanzados. Además, se propone implementar programas de
capacitación que mejoren las habilidades negociales de los participantes y desarrollar indicadores
claros de buena fe negocial.
El tipo de investigación es dogmática y básica, utilizando una metodología mixta que incluye el
análisis de convenios colectivos y el uso de encuestas para recopilar datos. El diseño de
investigación es descriptivo y correlacional, sin manipulación de variables. La población de
estudio incluye expertos en derechos laborales, trabajadores sindicalizados y diversas fuentes de
información relevante. Las técnicas e instrumentos de recolección de información incluyen
entrevistas semiestructuradas, encuestas y análisis de contenido mediante revisión de textos y
documentos.
The research work entitled "Analysis of good faith in negotiation and its relationship with the effectiveness of collective negotiations in the Regional Government of Ica period 2016 – 2019" addresses the influence of good faith in negotiation on the process of collective bargaining, with the aim of analyzing this influence and its manifestations in said procedure. It is argued that good faith in negotiation, represented as an independent variable, affects collective bargaining, considered as a dependent variable. The study identifies good faith in negotiation as essential for the success of collective negotiations, demonstrating its importance in the perception of the participants and its positive impact on the outcomes. Transparency, genuine commitment, and the pursuit of mutually beneficial solutions are highlighted as key elements in building trust and facilitating constructive dialogue between the parties. Likewise, it is concluded that the genuine and loyal effort of the parties in the process of collective bargaining contributes positively to achieving beneficial agreements for both parties. Adequate preparation, exchange of relevant information, and commitment to fulfilling agreements are identified as indicators of a good faith approach that enhances the effectiveness and fairness of the negotiation process. The confirmation of respect for the principle of good faith in negotiation is reflected in transparency, open communication, commitment to agreements, and the search for mutually beneficial solutions. Additionally, significant violation of workers' rights to full collective bargaining in the state sector is evidenced, due to limitations in the economic conditions provided by Law No. 31188. Regarding recommendations, it is suggested to strengthen good faith negotiation practices through training and capacitation of participants, establishing mechanisms for monitoring and evaluating agreements reached. Additionally, implementing training programs to improve negotiation skills of participants and developing clear indicators of good faith negotiation are proposed.
