El sistema de transferencia de propiedad inmueble y su relación con la seguridad jurídica peruana durante el año 2023

Abstract

El estudio buscó analizar la seguridad jurídica peruana en el sistema de transferencia de propiedad inmueble. Del mismo modo, correspondió a una investigación básica que además ostentó de un enfoque cualitativo, asimismo, contó con un nivel descriptivo y un diseño no experimental, donde se abarcó un elemento muestral de 3 abogados, los cuales participaron de la aplicación de la técnica entrevista. Igualmente, los resultados expusieron que el sistema de transferencia de propiedad inmueble deriva de un procedimiento sobre el cual se lleva a cabo el otorgamiento de la titularidad de una propiedad hacia el comprador, donde por medio de un contrato entre ambas partes se otorga el derecho de propiedad al comprador, no obstante, resulta fundamental el enfatizar en la seguridad jurídica en cuanto ello ofrece garantías del respeto a los derechos de las personas involucradas. Concluyendo que, el sistema de transferencia de propiedad inmueble otorga seguridad jurídica tanto estática como dinámica, debido a que representa un acto que se encuentra amparado legalmente y procede de un contrato obligatorio que se produce entre el vendedor y el comprador para el traspaso debido del bien. The study sought to analyze the Peruvian legal security in the real estate property transfer system. In the same way, it corresponded to a basic research that also had a qualitative approach, likewise, it had a descriptive level and a non-experimental design, where a sample element of 3 lawyers, who participated in the application of the interview technique, was included. Likewise, the results showed that the real estate transfer system derives from a procedure on which the ownership of a property is granted to the buyer, where by means of a contract between both parties the right of ownership is granted to the buyer, however, it is essential to emphasize legal certainty as it offers guarantees of respect for the rights of the persons involved. In conclusion, the real estate property transfer system provides both static and dynamic legal security, since it represents an act that is legally protected and comes from a binding contract between the seller and the buyer for the proper transfer of the property.
